What it does
This massive five-year surface transportation reauthorization covers highways, bridges, freight transportation and highway and motor-carrier safety. It addresses broker qualifications originally enacted under MAP-21, FMCSA registration and Principal Place of Business, affiliations, administrative civil penalties, broker recordkeeping and unlawful brokerage, motor-carrier entrant standards, chameleon carriers, DataQs, truck parking, restroom access, lease-purchase practices, truck size and weight, CDL/workforce issues and autonomous commercial vehicles. Section 7109 would establish a Cargo Theft and Freight Fraud Advisory Committee , bringing government, law enforcement and industry together to address issues including fleet impersonation, double-brokering, registration, data exchange and verification, cybersecurity, zero-trust verification and supply-chain integrity. Importantly, not everything here is new. PPOB is already addressed in federal regulations, and MAP-21 already addressed broker qualifications and certain affiliations. In several areas, Congress is attempting to build upon or finally implement requirements already on the books.
Full title: Building Unrivaled Infrastructure and Long-term Development for America's 250th Act or the BUILD America 250 Act This bill authorizes federal surface transportation (highway, public transportation, and rail) programs and activities through FY2031. The bill also establishes or modifies Department of Transportation (DOT) programs and policies that are a part of the federal-aid highway, transit, highway safety, motor carrier, research, hazardous materials, and rail programs. For example, the bill authorizes appropriations through FY2031 out of the Highway Trust Fund for the federal-aid highway
