FMCSA Defends Emergency Removal of ELDT Provider Over ELP Lapses

So whatELDT providers: FMCSA will pull TPR listings immediately, without a cure period, if roadside ELP citations trace back to your certified graduates. Audit your ELP instruction and BTW certifications now.

FMCSA's Office of Safety Programs filed a response defending its August 31, 2026 emergency removal of Start CDL Inc. from the Entry-Level Driver Training Provider Registry. The agency said an internal audit matched roadside English Language Proficiency (ELP) citations to training providers that had certified those drivers. The audit tied 62 of Start CDL's certified driver-trainees to subsequent ELP citations or out-of-service orders, the filing said — up from six drivers cited in the original notice, which the agency said resulted from an administrative mix-up with a similarly named company.

The agency argued it reasonably inferred that drivers who failed roadside ELP checks also lacked proficiency when Start CDL certified them, and that the volume of certifications showed willful disregard of training-curriculum rules under 49 CFR part 380. Because of that willfulness finding and the public-safety stakes, FMCSA said immediate removal without a chance to first correct deficiencies was lawful under 49 CFR 380.723(e). The agency asked the decisionmaker to deny Start CDL's petition and its request for a stay, saying the company had not shown a likelihood of success or proven irreparable harm.

What's next

  • FMCSA's decisionmaker will rule on Start CDL's petition for administrative review; no date given.
  • Start CDL may file a reply brief addressing the corrected evidence, per the agency's filing.
  • Watch for similar emergency removals tied to the agency's ELP enforcement policy (MC-SEE-2026-0002).
