FMCSA Reinstates Training Provider After ELP Certification Dispute
FMCSA's Office of Safety Programs filed a notice October 29 asking an administrative docket be closed after the agency reinstated GrandMax LLC, a Davenport, Florida CDL training provider, to its Training Provider Registry (TPR).
FMCSA had removed GrandMax from the TPR on an emergency basis August 31 under 49 U.S.C. 31305(c)(5) and 49 CFR 380.723(e). The removal followed an FMCSA audit that found drivers certified by GrandMax under the Entry-Level Driver Training program were later cited for failing to meet the English Language Proficiency standard. GrandMax filed a petition for review September 3, and FMCSA's Chief Safety Officer ordered the Office of Safety Programs to respond October 19.
Before responding, FMCSA reinstated GrandMax to the TPR on October 28, stating the company had taken corrective action to fix the deficiencies cited in the removal notice. In Monday's filing, the Office of Safety Programs told the agency the petition is now moot and asked that the matter be dismissed, terminated, and the docket closed. It also asked, if that request is denied, for 30 extra days to file supporting evidence.
What's next
- No ruling yet on the request to terminate the proceeding and close docket FMCSA-2026-3763.
- Watch for FMCSA action on the alternative 30-day extension motion if the dismissal request is denied.
