FMCSA Orders Response to Intercheck Appeal, Faces New Training-Registry Petitions
FMCSA's Chief Safety Officer Steven Dowling signed an order directing the agency's own Office of Safety Programs to respond within 10 days to a petition from Intercheck Driving Services LLC, which is challenging its emergency removal from FMCSA's Training Provider Registry. The registry lists schools authorized to certify entry-level driver training for CDL applicants. Intercheck filed its request for administrative review, a stay, and reinstatement on September 30, 2026, under 49 CFR 380.723(d)-(e). The order requires the Office of Safety Programs to submit the removal notice and all evidence considered.
Two other providers have filed similar challenges. Metropolitan Trucking, Inc. is contesting its removal, arguing FMCSA's own July 15, 2026 audit found it compliant on all seven certification items, and that the agency's 78-driver dataset does not support the action — citing a 497-day median gap between training and inspection and one record it called chronologically impossible. Cultural Technical Institute, LLC filed supplemental English-proficiency assessment materials in its own pending case.
The filings suggest FMCSA is applying stricter scrutiny to how training providers document English-proficiency instruction, even though removal does not automatically pause while under review.
