FMCSA Denies Louisiana Carrier's Bid to Reinstate Authority
FMCSA's Office of Registration rejected MWF Enterprises LLC's application to reinstate its motor property carrier authority after finding the company, doing business as Louisiana Transportation Solutions, failed to disclose a relationship with Fly High Freights LLC. Both carriers were run by the same operations manager, Melvin Fields. Fly High failed a new entrant safety audit in 2024 and remains under an FMCSA order to cease interstate transportation.
MWF appealed, arguing Fields relied on informal agency guidance and had no ownership stake in Fly High. The Office of Registration countered that Fields held himself out as Fly High's owner on federal filings and during the audit, and that the companies shared a phone number, address history and a second employee.
Reviewing the case de novo, Deputy Administrator Jesse P. Elison found MWF violated 49 U.S.C. 13902(a)(1)(C) by not disclosing the common-management relationship. He also found MWF was an affiliate of Fly High formed for an improper purpose under 49 CFR 386.73, created to dodge Fly High's compliance history and cease order. The appeal was denied.
What's next
- MWF may reapply only after disclosing the Fly High relationship and resolving Fly High's outstanding compliance deficiencies.
- No further appeal process is indicated in the order.
