FMCSA Reinstates Troy CDL School, Moves to Close Docket
FMCSA's Office of Safety Programs reinstated Troy CDL School LLC to the agency's Entry-Level Driver Training Provider Registry (TPR) on October 16, 2026, and then asked that a related review docket be closed as moot, according to a filing posted October 21 in docket FMCSA-2026-3701. FMCSA had removed the Dayton, Ohio school from the TPR on August 31 under 49 CFR 380.723(e), citing willful disregard of regulations after an audit found the school certified ELDT completion for drivers who had failed English Language Proficiency checks required under 49 CFR 391.11(b)(2). Troy CDL School petitioned for review on September 29; FMCSA's Chief Safety Officer ordered a response October 15, and the agency reinstated the school a day later after it took corrective action. FMCSA now argues the petition is moot and, if its motion to close the docket is denied, wants 30 more days to file evidence.
Separately, in docket FMCSA-2026-3961, FMCSA's Southern Service Center Regional Field Administrator filed a consent to arbitration in a civil penalty case against TM Transport USA LLC of Hialeah, Florida. The underlying Notice of Claim, served June 23, 2026, proposed a $6,490 penalty for a CDL violation under 49 CFR 383.37(a) and three driver-log violations under 395.8(k)(1).
