PHMSA Closes Hazmat Enforcement Cases Against Two Shippers

So whatShippers & carriers handling hazmat: PHMSA keeps closing enforcement dockets by compromise order. Confirm your own hazmat program addresses the violation types these cases likely involved.

PHMSA posted compromise orders on October 21, 2026, closing two separate hazardous materials enforcement dockets. One case, PHMSA-2026-3862, resolved a matter against Apple Express Courier, Inc., a Doral, Florida, carrier. The other, PHMSA-2026-3863, resolved a matter against Nutrien Ag Solutions, Inc., represented by outside counsel at Thompson Coburn.

Both postings consist of certificates of service and the agency's standard compromise order template, issued under the Office of Chief Counsel's authority pursuant to federal hazardous materials transportation law, 49 U.S.C. § 5101 et seq., and the Hazardous Materials Regulations at 49 CFR Parts 171-180. The order templates include fields for the number of violations found and the total civil penalty due, but the posted documents do not display the filled-in figures for either company. PHMSA's standard terms require payment by wire transfer, certified check, money order or credit card, with a 6% annual late-payment penalty on amounts more than 90 days past due and possible referral to the Treasury Department for collection if unpaid.

Neither docket entry describes the underlying violations.
