FMCSA Lets Self-Driving Trucks Swap Triangles for Beacons
FMCSA granted Aurora Operations, Inc. a five-year exemption from three rules that require drivers to place warning triangles, flares or steady-burning lamps around a stopped commercial motor vehicle. The exemption, effective October 7, 2026 and running through October 7, 2031, lets Aurora and other carriers operating Level 4 automated driving system trucks use cab-mounted amber beacons instead, as long as they notify FMCSA in writing first.
FMCSA had denied a broader version of this request in 2024 for lacking detail. This time Aurora submitted waiver data from over 500,000 miles of operation and two studies comparing driver response to beacons versus triangles. The agency received 402 comments; trucking groups, autonomous vehicle companies and some safety advocates supported it, while OOIDA, the Truck Safety Coalition and many individual drivers opposed it, citing blind spots, jackknife scenarios and insufficient real-world testing.
The exemption bars use on triple trailers, hazmat loads or passenger operations, requires redundant power and SAE J595-rated beacons, and limits operations to each vehicle's validated operational design domain. Carriers must report crashes within five days and file annual usage reports by November 1.
What's next
- 2026-10-07: Exemption already in effect.
